1.3 The intended meaning in these Terms and Conditions can only be derived in writing, in which case the other stipulations remain in full force.
1.4 All rights and claims, which are stipulated in these Terms and Conditions and in any additional agreements for the benefit of COMPETENCYPROFILES.com, are also stipulated for the benefit of intermediaries and other third parties called in by COMPETENCYPROFILES.com.
2.1 An agreement shall only be concluded upon acceptance of the registration of the buyer by COMPETENTENCYPROFILES.com. COMPETENCYPROFILES.com is entitled to reject registrations of buyers or to attach further terms and conditions to the delivery, unless expressly determined otherwise. In the event that a registration is not accepted, COMPETENCYPROFILES.com shall announce this to the registering party within ten (10) business days upon receipt of the registration.
2.2 COMPETENCYPROFILES.com reserves for itself the right to terminate its rendering of services at all times. Except for what is intended in article 5.3, COMPETENCYPROFILES guarantees that, in case of a possible termination of the website, all members will enjoy at least 1 full year of their subscription. Having said that, no contribution will be restituted in case of a possible termination of the website.
3.1 The stated prices for the products and services offered are in US $, not including VAT, unless stated otherwise or agreed upon in writing.
3.2 Payment needs to be made as soon as possible upon receipt of the invoice, whereby COMPETENCYPROFILES.com enables access to the website on receipt of the payment.
3.3 Payment can be made in (one of) the manner(s) indicated during the ordering process. Additional (payment/ordering) terms and conditions can be attached to a payment. When paying by bank transfer, the date when the bank account of COMPETENCYPROFILES.com is credited is considered the date of payment.
3.4 If the buyer is in default of any payment, COMPETENCYPROFILES.com shall be entitled to postpone or dissolve (the execution of) the agreement in question and associated agreements.
3.6 COMPETENCYPROFILES.com reserves for itself the explicit right to change the prices. If the prices for the subscription on the website increase in the period between the time of registration and the execution thereof, the buyer is entitled to cancel the registration or to dissolve the agreement within ten (10) business days after announcement of the price increase by COMPETENCYPROFILES.com.
4.1 The ownership of the products delivered shall only be transferred when the buyer has fulfilled all that is owed to COMPETENCYPROFILES.com on the basis of any agreement entered into. In this regard, the risk of the products is transferred to the buyer at the time of delivery.
5.1All intellectual property rights attached to the products delivered by COMPETENCYPROFILES.com need to be entirely and unconditionally respected by the buyers.
5.2Unauthorized use of the competency profiles delivered (among which (re-)use without payment) constitutes a violation of the copyrights to which COMPETENCYPROFILES.com is entitled.
5.3All words and logos on the website are owned by COMPETENCYPROFILES.com unless stated otherwise. The buyer does not have the right to make use of these brands without the written consent of COMPETENCYPROFILES.com.
5.4It is forbidden to frame the website. COMPETENCYPROFILES.com is not responsible or liable for access to the information on any website connected/linked from, or to, this website.
